ACCEPTANCE OF THE TERMS OF USE

The Municipality of Peyia under the name PEYIA MUNICIPALITY, hereinafter referred to as “the organisation”, administers the website https://pegeiamunicipality.com/, hereinafter referred to as “the Website”, and any information or item (e.g. photos, texts, graphs) included in it, hereinafter referred to as “the Material”, with the aim to present to the public information regarding its activity.

The use of the Website and the Material is subject to these Terms of Use, hereinafter referred to as  “the Terms of Use”, as currently in force, which also constitute the agreement between the organisation and every person visiting the Website regarding its use, hereinafter referred to as “the User or the Users”.

Any access to the Website and use of it (including simple navigation in it), indicates the unconditional acceptance by the User of the Terms of Use, as currently in force.

 

MODIFICATION OF THE TERMS OF USE

The organisation reserves the right to modify the Terms of Use and any other rule governing the use of the Website at its sole discretion, communicating each time every amendment by means of a relevant announcement on the home page of the Website. The Terms of Use shall indicate the date they were last updated.

The continuance of the use of the Website by the User after such announcement shall be deemed to constitute acceptance of such amendments.

The use of the Website is subject to the Terms of Use as currently in force. The User should periodically check the Terms of Use in order to be informed of their content and he shall be solely responsible for being kept up-to-date

 

SPECIFIC TERMS

In the event that the use of any service of the Website is governed by specific terms, such terms shall be considered as an integral part of these Terms of Use. However, in the event of conflict the specific terms of use of each service shall prevail.

 

USE OF THE WEBSITE BY MINORS

With the acceptance of the Terms of Use the User declares that he is an adult over 18 years of age or, if under the age of 18, that he has obtained the necessary consent by the person(s) who has(have) parental responsibility and that he will provide his/their details if so requested. The persons who have parental responsibility for minors are required to protect them from accessing content that is addressed to adults otherwise they are solely responsible.

It is the organisation’s policy not to check in advance the material or the information provided by each user. The organisation bears no liability for any access via the Internet to information, goods and services which are contrary to the law, the morality or are unsuitable or inappropriate for certain categories of people and in particular for minors.

If the user considers that the Material or part of it infringes in any way his rights or the rights of third parties he can send an e-mail to info@pegeiamunicipality.com specifying the Material or part of the Material he considers offensive and the reasons that support his claim.

 

MUNICIPALITY’S LIABILITY FOR THE CONTENT

The Website is used “as is”, subject to amendments on behalf of the organisation, without the possibility for the User to make amendments or other interventions.

The organisation puts every effort to make the use of the Website safe and to provide accurate, complete, valid, reliable and up-to-date information through it. But in any case the Users acknowledge and accept that, given the nature and the development of the products and the services of the organisation as well as the nature and the technical needs of the internet, the latter may not be able to fully control at all times its entire content and the safety of its Website and its services.

The organisation is neither bound, nor does it guarantee, or assume any responsibility with regard to the legality or not of the use of the Website by the Users, and with regard to the accuracy, the completeness and the relevancy of the content of the Website and its safety. Therefore the Users agree that they must evaluate the content and they shall be solely responsible for their actions that are based on the use of the Website, including any decision to rely on the accuracy, the completeness or/ and the validity of its content.

The user uses the site under his own responsibility. The organisation, its officers and its executives, its representatives or any third party involved in the creation, the production or the publication of the website shall not be liable, to the extent that the exclusion of liability is permitted by law, for any direct, indirect, moral, incidental or other damage arising from or related to the use of the website or the material, including, but not limited to, the unintentional download of computer viruses from the website or from the e-mails sent to him.

 

LINKS TO OTHER SITES

The Website may contain links to websites owned by or operated under the supervision of third parties outside the organisation. These links are provided only for the convenience of the User. The organisation does not control and is not responsible for the operation, the content, the privacy policies observed or the safety of these sites. For example, the organisation shall not be liable if the websites of third parties:

– violate the rights of a third party,

– are not safe or are inaccurate, incomplete or misleading,

– contain viruses or other programs of destructive nature.

The organisation does not endorse the content or the products or the services offered in these sites and it is not connected with the administrators of these sites. Where the website has links or hyperlinks to other web pages, the owners and/or administrators of these sites bear full (civil and criminal) responsibility for the safety, the legality and the validity of the content of their web pages, excluding any liability of the organisation, such as, but not limited to, the liability for a violation of intellectual and industrial property rights. If the User follows a link to these sites, he does so at his own risk as regards the connection and the access, without any engagement of the organisation.

 

INTERNATIONAL ACCESS

The Website can be accessed from all over the world. The Website may refer to products or services that are not available in the country of every User. These references do not suggest that the organisation intends to make these products available in these countries.

The organisation, which is part of the Cypriot Local Government and subject to the Cyprus law, controls, administers and is responsible for the operation of the Website. Without prejudice to the conditions specified in these terms regarding the organisation’s liability for the content, the organisation does not guarantee and bears no responsibility on whether the Website, the Material, the products and/ or the services referred to in it are legal in countries outside Cyprus. If the user gains access to the Website from a location outside Cyprus, he is solely responsible for complying with the local laws.

 

INTELLECTUAL AND INDUSTRIAL PROPERTY – LICENSING

Property Rights

The Website, including its software and the Material contained therein is intellectual and/or industrial property of the organisation and is protected by the relevant provisions of Cyprus, Community, and international law on the protection of intellectual and industrial property. Also, the composition of the content and the layout of its elements as it is contained in the Website belong exclusively to the organisation and are protected by the relevant provisions of Cyprus, Community, and international law. The User is not hereby granted any proprietary right on the Website and on the Material, but only the powers to use it, that are expressly provided for in these Terms of Use.

The organisation hereby expressly reserves all intellectual property rights in any and all the elements of the Website, as well as on the Material, including, but not limited to, intellectual property rights, industrial property rights on product trademarks, trade names, distinctive features etc.

 

Licensing – use restrictions

Provided that the User complies with the Terms of Use and the Privacy & Personal Data Protection Policy, the organisation grants him free of charge a limited, non-exclusive, non-transferable and non-assignable authorisation to gain access, to load, to display on the screen of his device the Website and the Material and generally to use it for the purpose specified in these Terms of Use. In this regard, each User acknowledges and accepts that the Website and the Material are intended only for personal, and not for commercial use. Each User shall be entitled to download and/or copy and/or store individual parts of the Material of the Website strictly for personal use and not for commercial purposes, without deleting the indications of source and provided that he will protect any and all the proprietary rights of the organisation against any infringement. For any other purpose such actions will be permissible only if they are performed with the written consent of the organisation. Access to the Website or any of the above-mentioned actions in no event will have the effect of creating a right, a title or a legal interest in any part of or in the whole Website that was downloaded and/or copied and/or saved.

In addition to the explicitly stated above permitted uses, the Website and the Material may not be reproduced, copied, leased, sold, sublicensed, assigned, transferred, exported, transmitted, retransmitted or distributed in whole or in part in any way by any User, nor be lent or conferred during use. In no case can the Website be used for commercial purposes. It is explicitly prohibited to modify, arrange, adapt, translate or in any other way convert the Website and the Material and to create derivative works or improvements. Similarly, it is prohibited to dismantle, repair or otherwise attempt to obtain the source code of the Website, and to perform reverse engineering (except to the extent permitted by law). The creation and/or publication of a database that contains important parts of the Website without the prior express consent of the organisation is prohibited.

On the basis of the above, the User undertakes not to create any derivative work based on the content of the Website, copy, reproduce, republish, upload, modify, transmit, sell or exploit in any manner, in whole or in part, the Website, its associated software or its Material. Furthermore, he undertakes not to enter the Website to an index, not frame it with another website, not to enter it as a link for direct access from another site to its internal information, not to copy its location to another server by creating an image and not to promise rights to the Website to a third party, without the express prior written consent of the organisation.

In addition, it is prohibited to perform any actions to circumvent or violate the safety rules or the rules for the use of the content provided for or imposed by any functionality (including inter alia the functionality of digital rights management) contained in the Website. It is prohibited to use the Website to access, copy, transfer, encode or retransmit content in violation of any law or rights of the organisation or third parties, as well as to remove, conceal or misrepresent the declarations of copyrights, trademarks or other exclusive rights declarations of the organisation or third parties that are attached or contained or accessed in conjunction with or through the Website.

It is prohibited to use the Website in any illegal manner, for any illegal purpose or in violation of applicable laws or regulations of the Cyprus law on intellectual property and related provisions of the European and the International law.

The Users by using the Website unreservedly accept, agree and undertake to use it lawfully and properly, and in particular in accordance with the terms set out herein.

The use of the Website, which constitutes a violation of the Terms of Use is strictly prohibited and will automatically result in the termination of the aforementioned license. The license granted to the User may be revoked freely by the organisation, without the need of a relevant prior notice.

A basic principle of the organisation’s policy is to respect and protect the intellectual property rights of third parties. If, however, the user considers that his intellectual property rights are being infringed  through the Website, he may inform the organisation, by sending an e-mail to info@pegeiamunicipality.com specifying the section of the Website which he considers that violates his rights and the reasons that he considers that establish the violation.

 

PERSONAL DATA AND PRIVACY PROTECTION

OFFICIAL SERVICE

The User agrees not to create or provide ways in which participation in the Website could be achieved through other websites or in a way that is not approved by the organisation.

The user undertakes and agrees not to use computer electromechanical equipment or software, or any other method not approved by the organisation, which will affect the Website.

 

AVAILABILITY AND SAFETY

Availability and Smooth Operation

The organisation shall make every reasonable effort regarding the maintenance and the availability of the Website. The Users, however, acknowledge that the Internet is a non-secure means and that the availability of websites can be affected by the equipment of the users, by other communication networks, by the services providing connection to the internet, the large number of people who are trying to use the Website at the same time or by other causes. For these reasons, Users agree that the organisation will bear no liability for the interruption or the non-smooth operation of the Website.

The Website and the organisation have nothing to do with the provision of internet connection services and the User remains solely responsible for the payment of all debts to the competent providers of such services and to ensure access to the Internet.

The Users agree and accept that the organisation may modify and/or discontinue temporarily or permanently the operation of all or part of the Website after or without warning the Users. For this reason, the organisation bears no liability for any damage resulting from the interruption of the operation or the non-smooth operation of the Website or the inability of Users to access it, its termination in whole or in part, any delay, non-delivery, interruption or poor reception quality of its services or any loss of contents or the existence of any kind of errors. The organisation does not warrant that the Website will be compatible with the computer, the hardware and the software of each User.

 

SOFTWARE AVAILABLE ON THIS SITE

The intellectual property rights or other rights on the software that is available for visiting the Website belong to the organisation or its providers/ licensors. In order for the User to access information on the Website he should sign a license with third party software providers. The ability of the User to access this information may depend on whether he has signed such licenses. The use of such software is governed by the terms of each license contract contained in the software. The organisation assumes no responsibility for the arrangement of such licenses. It is recommended not to install or use the software if the User has not obtained the relevant license of use. If the User, however, proceeds to such actions despite the absence of a license, he does so at his own risk.

 

MAINTENANCE

In any event, the organisation shall reserve the right to discontinue temporarily or permanently the whole or part of the Website at any time for maintenance or upgrading reasons or for any reason, without any further responsibility.

 

SECURITY

Although the organisation shall make every effort to protect the Website from digital viruses or/ and any other harmful or destructive files (or programs) designed to intervene, damage or restrict the operation of any software or telecommunications equipment, it cannot be guaranteed that the Website will never be infected by such elements. Consequently, the integrity and the safeguarding of each user’s software systems and equipment depends upon his own diligence and the organisation shall bear no liability in the event of infection of the electronic equipment (software and hardware) of the Users by viruses and other harmful files as set out above.

 

OBLIGATIONS OF THE USERS

Users accept and agree to make lawful use of the Website. Users are bound without limitation that by using the Website they shall not:

  • act in such a manner as to prevent and/or make the smooth or/ and lawful use of the Website and the other linked websites by other users impossible
  • act in such a manner as to infringe intellectual or industrial property rights of third parties (on the protection of intellectual property please read the Intellectual Property Protection)
  • act in such a manner as to mislead any third party as to the source of the content of the Website and/or harm in any way the reputation of the organisation
  • install, promote and/or transmit in any way through the Website digital viruses or/ and any other harmful or destructive files or/ and programs designed to destroy or restrict the operation of any software or telecommunications equipment or to prevent other users from using the Website,
  • install or promote by any manner of means unsolicited or not expressly approved by the organisation advertisements in any form, unsolicited emails (spam) and generally promote undesirable information by any manner of means
  • upload or transmit by any manner of means material and information that they are not entitled to disclose under provisions of law or private agreements (e.g. confidential information)
  • act in such a way as to infringe any rights or the personality of third parties, and in particular in such a way as to cause damage to a minor
  • interfere with or endanger the safety or in any other way cause damage to the Website, the Material hosted on it, the source codes of the software it is built with, the server where it is hosted or/ and networks linked to or accessible via the Website or other websites linked to it.
  • pursue a purpose, which is prohibited by these Terms of Use
  • take any action which could constitute or encourage conduct that could be considered a criminal offense, give rise to civil liability or otherwise violate any law
  • publish or transmit any material with threatening, untrue, misleading, abusive, harassing, libelous, vulgar, immoral, scandalous, pornographic or blasphemous content. The organisation will fully cooperate with all law enforcement authorities and will fully comply with any judicial decision requesting or ordering the disclosure of the identity of any person who publishes or transmits such information and material
  • collect e-mail addresses or other user data from the Website by electronic or other means with an aim to perform unwanted commercial or other communication with them
  • upload, transmit, store or render available to the public by any manner of means images of third parties without their consent.
  • they shall inform the organisation immediately as soon as they become aware of any unlawful or prohibited use of the Website by third parties

It is explicitly clarified that the User is prohibited to use the Website for advertising or promotions, unless otherwise expressly agreed with the organisation.

The use of any of the elements of the Material besides the use provided for in these Terms of Use, without the written permission of the organisation, is strictly prohibited. In the event of a breach of the terms of use the organisation will make full use of the remedies provided by the law, including criminal prosecution.

 

BREACH OF THE TERMS OF USE

In each case of breach of these Terms of Use, Users will be obliged to pay indemnification for any incidental and/or consequential damage to the organisation. If the organisation does not exercise its rights arising out of these Terms of Use, this shall not imply the waiver of its rights.

The organisation expressly reserves the right to supervise the implementation of these rules at its sole discretion.

 

INDEMNIFICATION

The User agrees to protect, hold harmless and indemnify the organisation, the partners, the employees and generally the staff of the organisation for any damage and expense, without limitation, it might suffer, that will be induced by or associated with, directly or indirectly, the misuse of the Website or the breach of these Terms of Use by the User.

 

TERMINATION

The organisation reserves the right to terminate without penalty and without any further responsibility the agreement concluded pursuant to this document with each User immediately and without notice if the User breaches the Terms of Use or any part thereof or if it is unable to confirm any information provided by the User within the framework of using the Website.

 

COMPLETE AGREEMENT – DIVISIBILITY

These Terms of Use, together with any other rules to which they refer or which are posted on the Website constitute the complete agreement between the organisation and each User with respect to the use of the Website. If for any reason a competent court judges that any of these Terms of Use is invalid and unenforceable, the validity and the legal effect of the remaining terms will not be affected or prejudiced.

 

RELATIONSHIP OF THE USER WITH THE ORGANISATION

The User agrees that no representative – represented or agent – principal relationship, partnership or cooperation of any kind or working relationship between him and the organisation is created as a result of the use of the Website by the User.

 

EVIDENCE

The printed version of the Website and the Terms of Use and any correspondence in electronic format will be accepted as evidence before judicial or administrative authorities.

 

APPLICABLE LAW AND JURISDICTION

These Terms of Use and any amendments thereto shall be governed by the Cyprus Law. For any dispute which may arise out of this Agreement and which cannot be settled extrajudicially, the courts of Nicosia shall have ration material jurisdiction.

All rights and remedies in accordance with the Terms of Use are cumulative and do not exclude other rights and remedies provided for by law or by another agreement.
